Terms of Service

These terms govern your use of the EDDM 360 Hybrid Marketing ("EDDM 360", "we", "us") website, client portal, and services. By requesting a quote, approving a campaign, or using the client portal, you agree to them. If you have questions, email info@eddm360.com.
1. The service
EDDM 360 is a done-for-you Every Door Direct Mail service: we handle route selection, mailer design, printing, preparation, and delivery to USPS on your behalf, along with campaign tracking and reporting. The specific scope, number of mail drops, and schedule for your campaign are set out in your quote or campaign agreement.
2. Quotes, pricing, and payment
- Quotes are based on the target routes, quantities, and program you select, and are valid for the period stated on the quote.
- Invoices are issued per your campaign agreement and are payable by the due date shown. Card and online payments are processed by Stripe.
- Postage rates are set by USPS and printing costs by our print partners; if they change materially between drops on a long-running program, we'll tell you before the affected drop and agree on any adjustment.
- We may pause design, printing, or mailing work on accounts with overdue balances until payment is received.
3. Your responsibilities
- Provide accurate business information, brand assets, and offer details, and respond to proof reviews in a timely way — mail dates depend on it.
- Ensure the content of your mailers is truthful, lawful, complies with USPS mailing standards, and doesn't infringe anyone's rights. You are responsible for the claims and offers your mailer makes.
- Honor the offers printed on your mailers for the stated period.
4. Proof approval
Nothing is printed without your approval. When you (or someone you've authorized on your account) approve a design proof in the client portal or in writing, that approval authorizes printing and mailing as shown. Please review proofs carefully: once you approve a proof, errors that were visible in it — spelling, dates, pricing, contact details — are your responsibility, and correcting them after printing requires a reprint at cost.
5. Scheduling and USPS delivery
We schedule drops so mailers arrive in the windows we plan together, and we hand mail to USPS with the proper EDDM preparation. Actual in-home delivery timing is controlled by USPS, not us; delivery windows are good-faith estimates, and USPS handling delays are outside our control.
6. Cancellations and refunds
- You may cancel future, un-started work with written notice. Amounts paid for drops not yet in production are refundable or creditable.
- Once a drop enters production — design approved and sent to print — its printing, postage, and fulfillment costs are committed and non-refundable.
- Multi-drop program pricing assumes the full program; if you cancel mid-program, completed drops may be re-rated at standard single-drop pricing per your campaign agreement.
7. Intellectual property
You keep all rights to your name, logo, and brand assets. Upon full payment, the final approved mailer designs we produce for your campaign are yours to use. We may display finished work in our portfolio and marketing unless you ask us not to in writing.
8. Disclaimers and limitation of liability
Direct mail works, but no one can promise a specific outcome. We do not guarantee any particular response rate, call volume, or revenue result from a campaign. The service is provided on an "as is" basis to the maximum extent permitted by law.
To the maximum extent permitted by law, our total liability for any claim arising out of the service is limited to the amount you paid us for the campaign giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages such as lost profits.
9. General
- These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
- If we update these terms, we'll change the effective date above; material changes affecting active clients will be communicated by email. Continued use of the service after a change means you accept it.
- If any part of these terms is found unenforceable, the rest remains in effect.
